Terms of Service for Harare Precision Painting Solutions

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern the provision of painting and related services by Harare Precision Painting Solutions ("we", "us", "our", or the "Company") to any customer, client, visitor, or other person who engages, requests, or uses our services ("you" or "Customer").

By requesting a quotation, booking a service, paying a deposit, granting access to a property, or otherwise engaging Harare Precision Painting Solutions, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all services provided by Harare Precision Painting Solutions, including any written estimate, invoice, work order, proposal, schedule, or service agreement issued by us.

2. Scope of Services

Harare Precision Painting Solutions provides professional painting and surface preparation services, which may include:

  • Interior painting
  • Exterior painting
  • Residential repainting
  • Commercial painting
  • Wall preparation and patching
  • Ceiling and trim painting
  • Decorative finishes

The exact scope of work will be defined in the quotation, proposal, work order, or written agreement accepted by the Customer. Any work not expressly included in the agreed scope is excluded unless approved in writing by both parties.

Colour matching, finish appearance, surface condition, and final results may vary depending on substrate condition, lighting, prior coatings, environmental factors, and product availability. We will use reasonable skill and care in performing the services.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate information regarding the property, surfaces, access requirements, and desired outcomes.
  • Ensure safe, lawful, and timely access to the property or worksite on the scheduled dates.
  • Remove or secure valuables, fragile items, electronics, furniture, and personal belongings before work begins, unless otherwise agreed in writing.
  • Disclose any known hazards, including structural issues, water damage, mould, lead-based paint, asbestos, pests, electrical risks, or other dangerous conditions.
  • Obtain any necessary permissions, approvals, permits, or consents required for the work.
  • Provide utilities reasonably necessary for the performance of the services, including water and electricity, unless otherwise agreed.
  • Review completed work promptly and notify us of any concerns within a reasonable time after completion.

You are responsible for any delay, additional cost, or damage caused by your failure to meet these obligations. We may suspend or terminate work if conditions at the site are unsafe, unlawful, or materially different from those disclosed.

4. Payment Terms and Conditions

All prices will be communicated in the applicable quotation, invoice, or written agreement. Unless stated otherwise, quotations are estimates based on the information available at the time and may be adjusted if the scope, site conditions, materials, or labour requirements change.

  • A deposit may be required before work begins.
  • Progress payments may be required for larger projects.
  • Final payment is due upon completion of the services, unless otherwise agreed in writing.
  • Late payments may result in suspension of work, withholding of deliverables, or additional administrative charges to the extent permitted by applicable law.
  • All taxes, duties, levies, or government charges applicable to the services are payable by the Customer unless expressly included in the quoted price.

If additional work is required due to hidden defects, poor surface condition, customer-requested changes, or unforeseen circumstances, we may issue a revised quotation or change order. Such additional work will only proceed with Customer approval, except where urgent action is reasonably necessary to protect persons, property, or the quality of the work.

5. Cancellation and Refund Policy

Cancellations should be made in writing by email or other agreed communication method. The following rules apply unless a different cancellation policy is stated in a specific quotation or contract:

  • If you cancel before materials are purchased or work is scheduled, any deposit may be refundable less reasonable administrative costs, where applicable.
  • If you cancel after materials have been purchased, prepared, or allocated, we may retain amounts sufficient to cover those costs.
  • If you cancel after work has started, you must pay for all work performed, materials used, and any non-recoverable costs incurred up to the cancellation date.
  • Rescheduling requests are subject to our availability and may incur additional charges if costs have already been incurred.

Refunds, if any, are issued only for amounts not earned or not reasonably incurred by Harare Precision Painting Solutions. We do not guarantee refunds for completed work where the services were performed in accordance with the agreed scope and reasonable workmanship standards.

Natural variations in paint colour, sheen, texture, and finish are not defects. Minor touch-ups, settling, and normal wear are not grounds for a refund.

6. Liability Limitations

To the maximum extent permitted by applicable law, Harare Precision Painting Solutions shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profit, loss of business, loss of use, or loss of data, arising from or related to the services.

Our total liability for any claim arising out of or relating to the services shall not exceed the amount paid by the Customer for the specific service giving rise to the claim, except where a different limit is required by applicable law.

We are not responsible for:

  • Pre-existing defects, structural issues, hidden damage, or deterioration in surfaces.
  • Damage caused by moisture, leaks, mould, pests, poor ventilation, or building movement.
  • Colour differences resulting from lighting, substrate absorption, prior coatings, or manufacturer batch variation.
  • Damage caused by the Customer, occupants, third parties, or events beyond our control.
  • Items not removed or protected by the Customer before work begins, unless we expressly agreed in writing to protect them.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

7. Intellectual Property Rights

All intellectual property rights in our business name, logos, branding, quotations, templates, photographs, designs, methods, documentation, and marketing materials remain the property of Harare Precision Painting Solutions or its licensors, unless otherwise agreed in writing.

You may not copy, reproduce, distribute, modify, publish, or use our materials for commercial purposes without our prior written consent.

Unless you object in writing before the work begins, you grant us permission to take photographs or videos of the completed work for quality assurance, record-keeping, and marketing purposes, provided that any personal data or identifying features are handled in accordance with these Terms.

8. Data Protection and Privacy

Harare Precision Painting Solutions may collect and process personal information such as your name, contact details, property address, service preferences, payment information, and communications for the purposes of:

  • Providing quotations and services
  • Scheduling and managing appointments
  • Processing payments and issuing invoices
  • Responding to enquiries and complaints
  • Maintaining business records and legal compliance
  • Improving our services and customer experience

We will take reasonable measures to protect personal information against unauthorized access, loss, misuse, or disclosure. We will not sell your personal information. We may share information with trusted service providers, subcontractors, or professional advisers only where necessary to perform the services or comply with legal obligations.

By engaging our services, you consent to the collection and use of your information as described in these Terms and in any applicable privacy notice. If you provide information about another person, you confirm that you have authority to do so.

9. Force Majeure

Harare Precision Painting Solutions shall not be liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, epidemic, pandemic, power outages, transport disruptions, labour disputes, civil unrest, government action, shortages of materials, supplier failure, or other unforeseen events.

In such circumstances, we may suspend, reschedule, or modify the services without liability, and we will make reasonable efforts to notify you and resume performance as soon as practicable.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our business practices, services, or legal requirements. The updated Terms will take effect when posted, issued, or otherwise communicated to you, unless a later effective date is stated.

Continued use of our services after any change constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of our services and notify us in writing.

11. Applicable Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws applicable in Zimbabwe, without regard to conflict of law principles, unless mandatory consumer or local laws require otherwise.

Any dispute arising out of or in connection with these Terms or the services shall be subject to the exclusive or non-exclusive jurisdiction of the competent courts or tribunals located in Harare, Zimbabwe, unless otherwise required by applicable law or agreed in writing by the parties.

13. Severability Clause

If any provision of these Terms is found to be invalid, unlawful, void, or unenforceable by a court or competent authority, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Any invalid or unenforceable provision shall, where possible, be replaced by a valid provision that most closely reflects the original intent of the parties and the commercial purpose of these Terms.
